For in-person yoga classes at Cross Creek Village
PLEASE READ CAREFULLY BEFORE SIGNING. This is a legally binding agreement. By signing this form, you acknowledge that you have read, understood, and agree to be bound by the following terms:
1. ASSUMPTION OF RISK. I acknowledge that participation in yoga classes and related activities involves inherent risks, including but not limited to: physical injury, muscle strain, sprains, fractures, joint injuries, aggravation of pre-existing conditions, cardiovascular events, and in rare cases, serious injury. I freely and voluntarily assume all such risks, both known and unknown, even if arising from the negligence of the Released Parties.
2. RELEASE AND WAIVER OF LIABILITY. In consideration of being permitted to participate in yoga classes, I, on behalf of myself, my heirs, executors, administrators, and assigns, hereby release, waive, discharge, and covenant not to sue the following Released Parties: the yoga instructor (Jessica), Cross Creek Village (CCV), its homeowners association, property management, board members, residents, and any affiliated persons, entities, officers, agents, employees, or volunteers, from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, or injury that may be sustained by me, whether caused by the negligence of the Released Parties or otherwise, while participating in any yoga class or activity, or while on or about the premises where classes are held.
3. INDEMNIFICATION. I agree to indemnify and hold harmless all Released Parties from any loss, liability, damage, or costs, including attorney’s fees, that they may incur due to my participation in yoga classes, whether caused by my negligence or otherwise.
4. MEDICAL ACKNOWLEDGMENT. I represent that I am physically fit and have no medical condition that would prevent my full participation in yoga classes. I acknowledge that it is my responsibility to consult with a physician prior to and regarding my participation. I agree that it is my responsibility to inform the instructor of any medical conditions, injuries, or limitations before each class.
5. GOVERNING LAW. This agreement shall be governed by and construed in accordance with the laws of the State of California. Any dispute arising under this agreement shall be subject to the exclusive jurisdiction of the courts of Los Angeles County, California.
6. SEVERABILITY. If any provision of this agreement is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
7. ACKNOWLEDGMENT. I acknowledge that I have read this Release of Liability and Assumption of Risk agreement, fully understand its terms, and understand that I am giving up substantial rights, including my right to sue. I acknowledge that I am signing this agreement freely and voluntarily.
